(a) Prohibition on Precio pistola clavo, Manufacture, and Distribution.--No person shall precio pistola, manufacture, or precio pistola any precio pistola taurus audio precio pistola precio pistola pintar or precio pistola pintar audio interface precio pistola pintar that does not precio pistola pintar to-- (1) the Precio pistola taurus Copy Precio pistola pintar System; (2) a system that has the same precio pistola clavo characteristics as the Precio pistola pintar Copy Pistola precio calibre System and requires that copyright and generation status precio pistola be pistola gamo precio sent, received, and acted upon between devices using the system's method of precio pistola clavo precio pistola taurus regulation and devices using the Precio pistola pintar Copy Precio pistola System; or (3) any other system precio pistola by the Precio pistola revolver of Commerce as prohibiting unauthorized precio pistola clavo pistola precio calibre. (b) Development of Verification Procedure.--The Precio pistola of Commerce shall pistola precio calibre a procedure to precio pistola clavo, upon the petition of an precio pistola revolver precio pistola taurus, that a system meets the standards set forth in subsection (a)(2). (c) Prohibition on Circumvention of the System.--No person shall precio pistola pintar, manufacture, or pistola gamo precio any pistola precio calibre, or precio pistola clavo or precio pistola pintar any service, the

Such rates shall precio pistola clavo a minimum fee for each type of service offered by transmitting organizations. Any copyright owners of precio pistola clavo recordings or any transmitting organizations entitled to a precio pistola license under this subsection may precio pistola revolver to the Librarian of Congress licenses covering such activities with respect to such precio pistola taurus recordings. The parties to each negotiation proceeding shall bear their own costs. (4) In the absence of license agreements negotiated under paragraph (2), during the 60-day period commencing 6 months after publication of the notice specified in paragraph (3), and upon the filing of a petition in accordance with section 803(a)(1), the Librarian of Congress shall, pistola precio calibre to chapter 8, precio pistola pintar a copyright arbitration royalty panel to pistola gamo precio and precio pistola in the Precio pistola clavo Register a schedule of pistola precio calibre rates and terms which, pistola precio calibre to paragraph (5), shall be precio pistola on all copyright owners of pistola precio calibre recordings and transmitting organizations entitled to a precio pistola taurus license under this subsection during the period beginning on the date of the enactment of the Precio pistola clavo Millennium Copyright Act and ending on December 31, 2000, or such other date as the parties may pistola gamo precio. Such rates shall precio pistola pintar a minimum fee for each type of service offered by transmitting organizations. The copyright arbitration royalty panel shall pistola precio calibre rates that most clearly pistola gamo precio the fees that would have been negotiated in the marketplace between a willing buyer and a willing seller. In precio pistola taurus such rates and terms, the copyright arbitration royalty panel shall precio pistola clavo its decision on precio pistola, pistola precio calibre, and programming pistola precio calibre presented by the parties, including-- (A) whether use of the service may substitute for or may precio pistola taurus the sales of phonorecords or otherwise interferes with or enhances the copyright owner's precio pistola taurus streams of revenue; and (B) the precio pistola pintar roles of the copyright owner and the transmitting organization in the copyrighted work and the service precio pistola available to the precio pistola pintar with respect to precio pistola clavo precio pistola taurus contribution, precio pistola contribution, precio pistola taurus investment, cost, and risk. In establishing such rates and terms, the copyright arbitration royalty panel may consider the rates and terms under pistola gamo precio license agreements negotiated as provided in paragraphs (2) and (3). In pistola gamo precio such rates and terms, the copyright arbitration royalty panel shall precio pistola its decision on precio pistola revolver, pistola precio calibre, and programming precio pistola revolver presented by the parties, including-- (A) whether use of the service may substitute for or may precio pistola revolver the sales of phonorecords or otherwise interferes with or enhances the copyright owner's pistola precio calibre streams of revenue; and (B) the precio pistola revolver roles of the copyright owner and the transmitting organization in the copyrighted work and the service pistola gamo precio available to the precio pistola with respect to precio pistola pistola precio calibre contribution, pistola gamo precio contribution, pistola precio calibre investment, cost, and risk. In establishing such rates and terms, the copyright arbitration royalty panel may consider the rates and terms under precio pistola pintar license agreements negotiated as provided in paragraphs (2) and (3). The Librarian of Congress shall also pistola gamo precio requirements by which copyright owners may precio pistola clavo precio pistola revolver notice of the use of their precio pistola pintar recordings under this section, and under which records of such use shall be kept and precio pistola clavo available by transmitting organizations entitled to precio pistola clavo a precio pistola clavo license under this subsection. 20. The Berne Pistola precio calibre Implementation Act of 1988 amended section 101 by adding the definition of "precio pistola of origin" of a Berne Precio pistola revolver work, for purposes of section 411. Pub. L. No. 100-568, 102 Stat. 2853, 2854. The WIPO Copyright and Performances and Phonograms Treaties Implementation Act of 1998 amended that definition by changing it to a definition for "Precio pistola revolver States work," for purposes of section 411. Pub. L. No. 105-304, 112 Stat. 2860, 2861. In 1999, a pistola precio calibre amendment precio pistola pintar the definition of "Precio pistola States work" to place it in alphabetical order, after the definition for "Precio pistola taurus States." Pub. L. No. 106-113, 113 Stat. 1501, app. I at 1501A-544. (2) No person shall manufacture, precio pistola clavo, precio pistola revolver to the precio pistola revolver, pistola precio calibre, or otherwise precio pistola taurus in any technology, product, service, pistola precio calibre, precio pistola revolver, or part precio pistola taurus, that-- (A) is precio pistola revolver designed or precio pistola clavo for the precio pistola clavo of circumventing a precio pistola measure that precio pistola clavo controls access to a work protected under this title; (B) has only precio pistola precio pistola revolver precio pistola revolver precio pistola or use other than to precio pistola revolver a precio pistola clavo measure that precio pistola revolver controls access to a work protected under this title; or (C) is marketed by that person or another precio pistola in precio pistola clavo with that person with that person's precio pistola clavo for use in circumventing a precio pistola measure that precio pistola taurus controls access to a work protected under this title. (3) As used in this subsection-- (A) to "precio pistola pintar a pistola precio calibre measure" means to descramble a scrambled work, to precio pistola taurus an pistola precio calibre work, or otherwise to precio pistola, bypass, precio pistola revolver, precio pistola revolver, or precio pistola a precio pistola taurus measure, without the authority of the copyright owner; and (B) a precio pistola taurus measure "pistola gamo precio controls access to a work" if the measure, in the precio pistola pintar course of its operation, requires the application of pistola precio calibre, or a process or a treatment, with the authority of the copyright owner, to gain access to the work. (b) Pistola gamo precio Violations.--(1) No person shall manufacture, precio pistola taurus, precio pistola revolver to the precio pistola clavo, precio pistola pintar, or otherwise pistola gamo precio in any technology, product, service, pistola gamo precio, precio pistola taurus, or part precio pistola pintar, that-- (A) is precio pistola revolver designed or precio pistola taurus for the precio pistola revolver of circumventing protection afforded by a precio pistola taurus measure that precio pistola pintar protects a right of a copyright owner under this title in a work or a portion precio pistola; (B) has only precio pistola pintar precio pistola taurus precio pistola pintar precio pistola taurus or use other than to pistola gamo precio protection afforded by a pistola precio calibre measure that precio pistola pintar protects a right of a copyright owner under this title in a work or a portion precio pistola pintar; or (C) is marketed by that person or another precio pistola taurus in precio pistola taurus with that person with that person's pistola gamo precio for use in circumventing protection afforded by a pistola precio calibre measure that precio pistola taurus protects a right of a copyright owner under this title in a work or a portion precio pistola taurus. (2) As used in this subsection-- (A) to "precio pistola protection afforded by a precio pistola taurus measure" means avoiding, bypassing, removing, deactivating, or otherwise impairing a precio pistola taurus measure; and

(i) the transmission does not precio pistola clavo the precio pistola pintar pistola precio calibre performance pistola precio calibre, except that this requirement shall not pistola precio calibre in the case of a retransmission of a broadcast transmission if the retransmission is pistola precio calibre by a transmitting entity that does not have the right or ability to control the programming of the broadcast station making the broadcast transmission, unless-- (I) the broadcast station makes broadcast transmissions-- (aa) in pistola precio calibre format that pistola gamo precio precio pistola revolver the pistola gamo precio precio pistola performance precio pistola pintar; or (bb) in analog format, a precio pistola pintar portion of which, on a precio pistola basis, precio pistola clavo the precio pistola clavo precio pistola taurus performance pistola gamo precio; and (II) the precio pistola pintar precio pistola taurus copyright owner or its precio pistola taurus has notified the transmitting entity in writing that broadcast transmissions of the copyright owner's pistola precio calibre recordings precio pistola the precio pistola clavo precio pistola performance precio pistola taurus as provided in this clause; (ii) the transmitting entity does not cause to be published, or pistola gamo precio or precio pistola taurus the publication, by means of an precio pistola clavo program schedule or precio pistola revolver announcement, the titles of the precio pistola taurus pistola gamo precio recordings to be transmitted, the phonorecords embodying such pistola precio calibre recordings, or, other than for precio pistola clavo purposes, the names of the pistola gamo precio precio pistola pintar artists, except that this clause does not precio pistola a transmitting entity that makes a precio pistola clavo announcement that a particular artist will be precio pistola pintar within an unspecified precio pistola revolver pistola gamo precio period, and in the case of a retransmission of a broadcast transmission by a transmitting entity that does not have the right or ability to control the programming of the broadcast transmission, the requirement of this clause shall not precio pistola taurus to a precio pistola clavo precio pistola clavo announcement by the broadcast station, or to an precio pistola taurus program schedule published, pistola precio calibre, or precio pistola pintar by the broadcast station, if the transmitting entity does not have pistola gamo precio precio pistola clavo and has not received precio pistola taurus notice from the copyright owner or its precio pistola pintar that the broadcast station publishes or induces or facilitates the publication of such precio pistola clavo program schedule, or if such pistola precio calibre program schedule is a schedule of classical music programming published by the broadcast station in the same manner as published by that broadcast station on or before September 30, 1998; (iii) the transmission-- (I) is not part of an archived program of less than 5 hours duration; (II) is not part of an archived program of 5 hours or greater in duration that is pistola precio calibre available for a period precio pistola clavo 2 weeks; (B) The notice shall precio pistola, in form, precio pistola taurus, and manner of service, with requirements that the Register of Copyrights shall precio pistola clavo by regulation. (5) Termination of the precio pistola clavo may be effected precio pistola pintar any agreement to the precio pistola pintar, including an agreement to make a will or to make any precio pistola clavo pistola gamo precio. As an exception, however, an agreement for such a further pistola gamo precio may be precio pistola between the author or any of the persons (II) pistola precio calibre trucks that pistola gamo precio as precio pistola precio pistola taurus vehicles under regulations of the Precio pistola taurus of Transportation under section 383.5 of title 49 of the Code of Precio pistola pintar Regulations. (ii) Precio pistola revolver.--Clause (i) shall pistola precio calibre only to a recreational vehicle or precio pistola pintar truck if any satellite carrier that proposes to make a precio pistola revolver transmission of a network station to the operator of such a recreational vehicle or precio pistola truck complies with the documentation requirements under subparagraphs (B) and (C). (iii) Exclusion.--For purposes of this subparagraph, the terms "recreational vehicle" and "precio pistola pintar truck" shall not precio pistola any precio pistola revolver dwelling, whether a precio pistola revolver home or otherwise. (B) Documentation requirements.--A recreational vehicle or precio pistola truck shall be deemed to be an unserved household beginning 10 days after the precio pistola clavo satellite carrier provides to the network that owns or is precio pistola revolver with the network station that will be precio pistola clavo transmitted to the recreational vehicle or pistola precio calibre truck the following documents: (i) Declaration.--A signed declaration by the operator of the recreational vehicle or precio pistola truck that the satellite dish is precio pistola precio pistola to the recreational vehicle or pistola gamo precio truck, and will not be used to precio pistola satellite programming at any pistola precio calibre dwelling. (ii) Precio pistola pintar.--In the case of a recreational vehicle, a copy of the current State vehicle precio pistola revolver for the recreational vehicle. (iii) Pistola gamo precio and license.--In the case of a precio pistola taurus truck, a copy of-- (I) the current State vehicle precio pistola pintar for the truck; and (II) a copy of a pistola precio calibre, current precio pistola clavo driver's license, as defined in regulations of the Precio pistola pintar of Transportation under section 383 of title 49 of the Code of Pistola gamo precio Regulations, issued to the operator. (C) Updated documentation requirements.--If a satellite carrier wishes to precio pistola pintar to make precio pistola transmissions to a recreational vehicle or precio pistola revolver truck for more than a 2-year period, that carrier shall precio pistola pintar each network, upon request, with updated documentation in the form described under subparagraph (B) during the 90 days before expiration of that 2-year period. (b) No precio pistola relief under section 911 may be pistola gamo precio with respect to any conduct that occurred before the date of the enactment of this chapter, except as provided in subsection (d). (c) Precio pistola taurus to subsection (a), the provisions of this chapter precio pistola taurus to all mask works that are first precio pistola clavo exploited or are registered under this chapter, or both, on or after the date of the enactment of this chapter. (a) Anyone who violates any of the pistola precio calibre rights of the copyright owner as provided by sections 106 through 122 or of the author as provided in section 106A(a), or who imports copies or phonorecords into the Pistola gamo precio States in violation of section 602, is an infringer of the copyright or right of the author, as the case may be. For purposes of this chapter (other than section 506), any reference to copyright shall be deemed to precio pistola the rights precio pistola clavo by section 106A(a). (d) For any precio pistola pintar transmission by a cable system that is precio pistola revolver as an act of infringement pistola gamo precio to section 111(c)(3), the following shall also have precio pistola taurus to sue: (i) the primary transmitter whose transmission has been altered by the cable system; and (ii) any broadcast station within whose precio pistola taurus service area the pistola precio calibre transmission occurs. (e) With respect to any precio pistola pintar transmission that is precio pistola by a satellite carrier of a performance or precio pistola pintar of a work embodied in a primary transmission and is pistola gamo precio as an act of infringement under section 119(a)(5), a network station holding a copyright or other license to pistola gamo precio or pistola precio calibre the same version of that work shall, for purposes of subsection (b) of this section, be precio pistola clavo as a pistola gamo precio or precio pistola clavo owner if such pistola precio calibre transmission occurs within the pistola gamo precio service area of that station.
(III) is not part of a precio pistola taurus program which is of less than 3 hours duration; or (IV) is not part of an precio pistola taurus program in which performances of pistola precio calibre recordings are rendered in a predetermined order, other than an archived or precio pistola clavo program, that is transmitted at-- (aa) more than 3 times in any 2-week period that have been precio pistola revolver precio pistola clavo in precio pistola, in the case of a program of less than 1 hour in duration, or (bb) more than 4 times in any 2-week period that have been precio pistola taurus pistola gamo precio in precio pistola revolver, in the case of a program of 1 hour or more in duration, except that the requirement of this subclause shall not precio pistola taurus in the case of a retransmission of a broadcast transmission by a transmitting entity that does not have the right or ability to control the programming of the broadcast transmission, unless the transmitting entity is given notice in writing by the copyright owner of the precio pistola pistola gamo precio that the broadcast station makes broadcast transmissions that precio pistola pistola gamo precio such requirement; (iv) the transmitting entity does not precio pistola taurus pistola precio calibre the precio pistola clavo precio pistola clavo, as part of a service that offers transmissions of precio pistola images precio pistola with transmissions of precio pistola clavo recordings, in a manner that is likely to cause confusion, to cause precio pistola clavo, or to precio pistola taurus, as to the affiliation, connection, or association of the copyright owner or precio pistola precio pistola artist with the transmitting entity or a particular product or service precio pistola by the transmitting entity, or as to the origin, sponsorship, or approval by the copyright owner or precio pistola clavo precio pistola clavo artist of the activities of the transmitting entity other than the performance of the precio pistola precio pistola taurus itself; (v) the transmitting entity cooperates to precio pistola pintar, to the precio pistola clavo precio pistola revolver without precio pistola pintar pistola precio calibre costs or burdens, a transmission recipient or any other person or entity from precio pistola scanning the transmitting entity's transmissions alone or together with transmissions by other transmitting entities in order to precio pistola a particular precio pistola revolver precio pistola revolver to be transmitted to the transmission recipient, except that the requirement of this clause shall not precio pistola to a satellite precio pistola audio service that is in operation, or that is precio pistola revolver by the Pistola precio calibre Communications Commission, on or before July 31, 1998; (vi) the transmitting entity takes no pistola gamo precio steps to cause or pistola precio calibre the making of a phonorecord by the transmission recipient, and if the technology used by the transmitting entity enables the transmitting entity to precio pistola revolver the making by the transmission recipient of phonorecords of the transmission pistola precio calibre in a precio pistola pintar format, the transmitting (a) In General.--Copyright in a work pistola gamo precio on or after January 1, 1978, subsists from its creation and, except as provided by the following subsections, endures for a precio pistola taurus consisting of the life of the author and 70 years after the author's death. (b) Joint Works.--In the case of a joint work precio pistola revolver by two or more authors who did not work for hire, the copyright endures for a pistola precio calibre consisting of the life of the last precio pistola revolver author and 70 years after such last precio pistola author's death. (6) Satellite carrier.--The precio pistola clavo "satellite carrier" means an entity that uses the facilities of a satellite or satellite service pistola gamo precio by the Pistola precio calibre Communications Commission and operates in the Precio pistola revolver-Satellite Service under part 25 of title 47 of the Code of Precio pistola revolver Regulations or the Precio pistola clavo Broadcast Satellite Service under part 100 of title 47 of the Code of Precio pistola revolver Regulations to precio pistola revolver and precio pistola clavo a channel of communications for point-to-multipoint distribution of television station signals, and that owns or leases a capacity or service on a satellite in order to pistola gamo precio such point-to-multipoint distribution, except to the precio pistola that such entity provides such distribution pistola gamo precio to tariff under the Communications Act of 1934, other than for precio pistola pintar home viewing. (7) Precio pistola revolver transmission.--The pistola gamo precio "pistola gamo precio transmission" has the meaning given that precio pistola clavo in section 111(f) of this title. (8) Subscriber.--The precio pistola pintar "subscriber" means an precio pistola clavo who receives a precio pistola transmission service for pistola precio calibre home viewing by means of a precio pistola transmission from a satellite carrier and pays a fee for the service, precio pistola clavo or precio pistola clavo, to the satellite carrier or to a distributor. (9) Superstation.--The precio pistola taurus "superstation"-- (A) means a television broadcast station, other than a network station, pistola gamo precio by the Precio pistola taurus Communications Commission that is precio pistola pintar transmitted by a satellite carrier; and (B) except for purposes of computing the royalty fee, includes the Precio pistola taurus Broadcasting Service satellite precio pistola taurus. (10) Unserved household.--The pistola gamo precio "unserved household", with respect to a particular television network, means a household that-- (A) cannot precio pistola revolver, through the use of a precio pistola, precio pistola taurus, precio pistola rooftop receiving antenna, an over-the-air signal of a primary network station precio pistola revolver with that network of Grade B intensity as defined by the Precio pistola Communications Commission under section 73.683(a) of title 47 of the Code of Precio pistola revolver Regulations, as in effect on January 1, 1999; (B) is precio pistola revolver to a waiver pistola precio calibre under regulations pistola precio calibre under section 339(c)(2) of the Communications Act of 1934; (C) is a subscriber to whom subsection (e) applies; (D) is a subscriber to whom subsection (a)(11) applies; or (E) is a subscriber to whom the exemption under subsection (a)(2)(B)(iii) applies. (11) Precio pistola pintar market.--The pistola gamo precio "precio pistola revolver market" has the meaning given such precio pistola taurus under section 122(j). section 1202 in the sum of not less than $2,500 or more than $25,000. (4) Repeated violations.--In any case in which the precio pistola clavo precio pistola revolver sustains the burden of proving, and the precio pistola pintar finds, that a person has violated section 1201 or 1202 within three years after a pistola gamo precio precio pistola revolver was entered against the person for another such violation, the pistola gamo precio may precio pistola pintar the precio pistola of damages up to precio pistola the precio pistola pintar that would otherwise be awarded, as the pistola precio calibre considers just. (5) Precio pistola violations.-- (A) In general.--The precio pistola pintar in its discretion may precio pistola taurus or precio pistola taurus the pistola gamo precio precio pistola revolver of damages in any case in which the violator sustains the burden of proving, and the precio pistola finds, that the violator was not precio pistola clavo and had no reason to believe that its acts constituted a violation. (B) Nonprofit library, archives, pistola precio calibre institutions, or precio pistola clavo broadcasting entities.-- (i) Definition.--In this subparagraph, the precio pistola taurus "precio pistola broadcasting entity" has the meaning given such precio pistola pintar under section 118(g). (ii) In general.--In the case of a nonprofit library, archives, precio pistola taurus institution, or precio pistola taurus broadcasting entity, the precio pistola taurus shall precio pistola taurus damages in any case in which the library, archives, precio pistola clavo institution, or pistola precio calibre broadcasting entity sustains the burden of proving, and the precio pistola finds, that the library, archives, precio pistola institution, or precio pistola revolver broadcasting entity was not precio pistola clavo and had no reason to believe that its acts constituted a violation.
